Granting a Restraining Order in Nevada

Finding yourself in a situation where your safety is compromised can be overwhelmingly stressful.

In Nevada, temporary protection orders, also known as temporary restraining orders, are legally enforceable court orders issued to prevent an individual from engaging in activities that could harm or intimidate another person.

Though commonly associated with domestic violence situations, these orders also extend to cases involving workplace harassment, aggravated stalking, sexual assault, child abuse, and elder abuse.

Nevada’s court system considers several factors when granting a restraining order:

  • Evidence of threat or harm
  • Immediacy of danger
  • Relationship to the petitioner
  • Past incidents
  • Protection needs
  • Impact on minor children
  • Overall circumstances

Medical reports, text exchanges, and eyewitness testimony each play a pivotal role in determining whether the court will grant the protective order. Smith Legal Group will help you gather the necessary proof for a compelling court argument, maximizing your chances of a favorable outcome.

Filing for Temporary Protection Orders in Nevada

The first step to obtaining a temporary protection order is to file an application at your local justice court.

Depending on your situation, you can file for one of five of the following types of TPO:

  • Domestic violence. People or a parent/guardian on behalf of their minor child experiencing harm or about to experience harm, and in a relationship created by blood, marriage, intimate partnership, or dating.
  • Stalking and harassment. People experiencing harm or about to experience harm by stalking and/or harassment, and are siblings, cousins, or do not have a relationship by blood, marriage, or dating.
  • Protection of minors. A parent or guardian who believes that someone is committing a crime of physical or mental injury, sexual abuse, or sexual exploitation of a child.
  • Workplace harassment. Employers who need to keep someone away from an employee or the workplace.
  • Sexual assault. Victims of a sexual crime, including attempted force or a threat to use force.

Nevada courts usually act fast, often reviewing your application within the first 24 hours of the filing.

If approved, an order of protection can be issued, valid for up to 45 days. During this period, a more comprehensive court hearing is scheduled to decide on an extended protection order. It’s crucial to arrive prepared, as the judge will require evidence to support your case.
